Orison S. Marden Moot Court Competition

We invite you to the Final Argument of the Marden Competition on Wednesday, April 6 from
5:00 p.m. to 7:00 p.m. in Tishman Auditorium. Named for the famous NYU Alumnus, the
Orison S. Marden Competition is an annual, school-wide moot court tournament open to all
second-year and third-year students. The NYU Moot Court Board administers the competition and
drafts the problems for both the Fall Elimination and Spring Semifinal Rounds.
The Final Argument of the Marden Competition will feature four of our law students arguing before
a panel of federal judges. We welcome Judge William A. Fletcher of the United States Court of
Appeals for the Ninth Circuit, Judge Michelle T. Friedland of the United States Court of Appeals for
the Ninth Circuit, and Roger L. Gregory of the United States Court of Appeals for the Fourth
Circuit.
In the case in question, the Department of Labor seeks to enforce the Fair Labor Standards Act
("FLSA") against the Church of YouthExistence in response to child labor law violations regarding
fifteen year-old Jane Doe, who worked as a camp counselor at a summer retreat of the Church. The
contested issues that students will be arguing are (1) whether the Church was properly named as the
employer of Doe and (2) if the Church is her employer, whether Doe is a minister and the
ministerial exception applies, thus exempting the Church from application of the FLSA.
