NYU School of Law invites you to the James Madison Lecture on Wednesday, October 18, 2023, at 6:00 p.m. in Vanderbilt Hall, Greenberg Lounge, located at 40 Washington Square South.

The lecture, "Major Questions About the Administrative State" will be presented by Judge Cornelia (Nina) Pillard, United States Court of Appeals for the District of Columbia Circuit. Is the administrative state under attack? The Supreme Court in 2019 narrowly rejected a request to reinvigorate a pre-New Deal nondelegation doctrine to curtail federal agency policymaking authority. The Court has since minted a new “major questions doctrine” and struck down federal agency responses to COVID, climate change, and student loan relief. This Term, the Court is poised to reconsider Chevron v. NRDC, the 1984 precedent requiring courts to follow agencies’ reasonable interpretations of ambiguities in their governing statutes. The D.C. Circuit’s distinctive docket includes many challenges to agency action, making it a central locus of disputes about the appropriate function of executive agencies in regulating American life. Drawing on that experience, Judge Pillard will reflect on what is at stake in this watershed moment for the administrative state.
