Choosing the Battlefield: Recent Trends in Forum Choice

This year's symposium, Choosing the Battlefield: Recent Trends in Forum Choice will feature panels on two timely trends in American adjudication. The first will be a discussion of judge shopping, the practice of filing a case in a particular court to ensure it appears in front of a favored judge. The conversation will be led by Prof. Samuel Issacharoff of NYU Law, who will be joined by Prof. Robin Effron from Brooklyn Law School and Alice Clapman from the Brennan Center for Justice.
The second will be a discussion of SEC v. Jarkesy, where the Supreme Court held that defendants in SEC civil enforcement actions were entitled to exercise their 7th Amendment right to trial before a jury. This conversation will be led by Steven Peiken, the former co-director of the SEC's enforcement division and a partner at Sullivan & Cromwell, who will be joined by Prof. Urska Velikonja from the Georgetown University Law Center and David Zornow of Skadden, Arps, Slate, Meager, and Flom, LLP.
